Beta terms

These terms apply to taking part in the beta of the Downwind app (Apple TestFlight), provided by Christoph Umbricht, Untersiggenthal, Switzerland («Downwind», «we»). By signing up for the beta or using a beta version you accept them. Our privacy policy applies as well.

1. Beta software

Beta versions are test versions. They can contain errors, crash or show wrong values. Features can change or disappear without notice.

2. Not for navigation – the pilot in command decides

Downwind is not for navigation and not for flight planning. Maps, traffic circuits (not verified by the airfields), routes, weather and the 90-day indication are for information only. Plan and fly with official charts, AIP, VAC and NOTAM. The responsibility for every flight stays with the pilot in command.

3. Safety

Operate the app before taxi and after shutdown only – never in critical phases of flight. Never fly lower, faster, longer or in worse weather because of Downwind, its challenges or routes.

4. Your logbook and your data

Please keep your official logbook; Downwind does not replace it during the beta. In rare cases data can be lost during the beta – export your logbook regularly (Settings → Data). How we handle personal data is described in the privacy policy.

5. Costs and Pro

The beta is free. As a thank you, beta testers get Downwind Pro until the date shown in the app. Pro never renews automatically and nothing becomes payable without your active purchase in the App Store; prices after the launch are announced in advance.

6. Feedback

We are grateful for feedback. You allow us to use your suggestions to improve Downwind, free of charge and without an obligation to implement them.

7. Content and behaviour

You are responsible for what you post (flights, photos, comments, messages) and need the rights to it; share photos of other people only with their consent. No unlawful, offensive or misleading content. We may hide content and block accounts that break these rules.

8. End of the beta

TestFlight versions expire after 90 days. We can end the beta or your participation at any time. You can leave at any time and delete your account in the app (Settings → Account).

9. Liability

Downwind is provided «as is», without warranty of availability or accuracy. Liability is excluded as far as the law permits; this does not apply to intent or gross negligence (Art. 100 Swiss Code of Obligations) or to mandatory consumer law.

10. Law and place of jurisdiction

Swiss law applies. Place of jurisdiction is Baden (canton of Aargau), unless a mandatory place of jurisdiction applies.
